Enforcement of Foreign Judgements

Foreign judgments are enforced in Kuwait on the basis of reciprocity as stipulated under the Civil and Commercial Procedure Code, Law No. 38 of 1980. Reciprocity can be shown to exist, if the foreign Court has in some other case enforced a judgment from a Kuwaiti Court. Reciprocity is also established in case of any bi-lateral treaties executed between Kuwait and the foreign country. The only treaties that exist are with Egypt and Tunisia. In practice, judgments issued by Courts in countries other than those referred to above, enforcement becomes extremely difficult. A new case is to be instituted in Kuwait and the foreign judgment can be used as evidence in that case.
